Dana and Gary Gayner say their veterinarian gave their 2-year-old German shepherd a sedative instead of euthanizing the animal; then the clinic turned around and gave the dog to another owner, because they considered the owners "heartless," according to an article by The Associated Press. The Gayners say their dog had increasingly frequent and debilitating seizures and that they made the decision to euthanize their pet only after weeks of research and soul-searching.

In the lawsuit, the Gayners say they found out about the "rescue" from a former clinic employee, who called them and said their dog was still alive. The couple tried to get the dog back, without success. The dog was later euthanized after she fell into a coma-like state for two days. The Gayners have filed a lawsuit that seeks unspecified damages for fraud, negligence, and defamation.
